The Sindh High Court (SHC) overturned a written petition urging the departments concerned to allow citizens to consume up to 10 grams of charas.
A citizen named Ghulam Asghar reportedly submitted the petition to SHC, which was heard today by a two-headed bank.
During the hearing, Justice Muhammad Ali Mazhar expressed displeasure with the defendant for filing such a petition. While Justice Mazhar rejected the petition after it was found not to be serviceable in the first hearing, he asked Ghulam Asghar, “Do you want everyone in the country to take hashish?” He added that the litigant should propose how much fine to be imposed on him for filing such a petition.
He told the bank that many countries around the world have legalized hashish consumption. Pakistan can also generate significant revenue from legalizing charas.
In this regard, Justice Mazhar suggested the litigant move to one of these countries if he wanted to use drugs, adding that Pakistan did not need any income from such funds as there were numerous legal ways to increase the income.

تفصیلات کے مطابق غلام اصغر نامی شہری نے ایس ایچ سی میں درخواست دائر کی تھی جس کی سماعت آج دو رکنی بینچ نے کی۔
سماعت کے دوران جسٹس محمد علی مظہر نے اس نوعیت کی درخواست دائر کرنے پر قانونی چارہ جوئی پر برہمی کا اظہار کیا۔
پہلی سماعت پر قابل سماعت قرار دینے کے بعد عرضی کو خارج کرتے ہوئے جسٹس مظہر نے غلام اصغر سے پوچھا کہ “کیا آپ چاہتے ہیں کہ ملک میں ہر کوئی چرس لے؟”
انہوں نے مزید کہا کہ قانونی چارہ جوئی کو مشورہ دینا چاہئے کہ اس طرح کی درخواست داخل کرنے پر ان پر کتنا جرمانہ عائد کیا گیا ہے۔
انہوں نے بینچ کو آگاہ کیا کہ دنیا بھر کے بہت سے ممالک نے ہاش کے استعمال کو قانونی حیثیت دی ہے۔ پاکستان چارس کو قانونی حیثیت دے کر خاصی آمدنی بھی حاصل کرسکتا ہے۔
اس پر ، جسٹس مظہر نے قانونی چارہ جوئی سے کہا کہ اگر وہ منشیات کا استعمال کرنا چاہتے ہیں تو ان ممالک میں سے کسی ایک میں منتقل ہوجائیں۔
